Operators of funeral home plead guilty to multiple fraud charges
Apr 27, 2018Tim and Becky King, who run the Filbeck-Cann and King Funeral Home, have already paid $300,000 in restitution and have about $62,000 left to pay, said Marshall County Commonwealth Attorney Mark Blankenship.Both pleaded guilty to two counts of fraudulent insurance act of less than $500 and fraudulent insurance act of $500 or more but less than $10,000. They also pleaded guilty to one count each of theft by unlawful taking or disposition of $500 or more but less than $10,000 and criminal possession of a forged instrument.By their pleas, the couple admitted selling fake insurance policies and keeping the money from themselves.Blankenship said initially he was seeking 30 days in jail for each defendant, but Tim King asked to serve the 30 days for his wife's involvement, as he admitted to greater culpability in the actions.Defense attorney Mark Bryant said Tim King has long maintained that he was more responsible for the crimes than his wife."There were a lot of things she just did not know," Bryant said. "What she really acknowledged that she had done was something she didn't even know was a crime."Along with increasing Tim King's jail time, the new agreement called for Becky King to serve 30 days in home incarceration to enable her to care for the couple's child.In addition to the jail time, the plea deal calls for a five-year diversion, after which, if the two do not run afoul of the law again, the charges will be dismissed. After a waiting period, the record can eventually be expunged.Blankenship said he was pleased with the agreement, noting that both previously had clean criminal records."I think diversion is a good program. It gives people a chance to stay on the right side of the law, look at this as just one major mistake in their life and turn it around and do something good."Bryant said no individuals or their families who bought the fraudulent policies were harmed, as those who didn't die didn't make insurance claims, and the funeral home held services for those who did die.He described the fal...
